Recent Notable Case: 2022 Recovery Of $12 Million Dollars
Facts: Negligent nurse midwife fails to recognize medical emergency indicated by decelerations in unborn baby’s fetal heart rate and also fails to notify OBGYN of the emergency and request his assistance with delivery. As the result, the baby suffered severe hypoxia (oxygen deprivation) and severe ischemia (deprivation of blood) in the womb, that resulted in Hypoxic Ischemic Encephalopathy, Cerebral Palsy and Spastic Quadriplegia. Defendant alleged the baby’s neurologic injuries were caused by various conditions including, an infection that resulted in “Chorioamnionitis”; Fetal Infection Response Syndrome (FIRS), “genetics” etc. This settlement represents the third largest medical malpractice settlement nationwide in 2022. This settlement also represents the largest FTCA medical malpractice settlement in Florida and one of the largest FTCA settlements, of any type (if not the largest), that has been recovered in the State of Florida.
