A Sharp Eye On Justice: Behind Miami Attorney Bo Sharp’s Latest Record-Setting Birth Injury Settlement
Noted Miami Attorney Richard “Bo” Sharp, Esq. of Mallard & Sharp, P.A. is no stranger to success when it comes to achieving justice and securing fair compensation for victims of birth injury medical malpractice negligence. In 2017, he served as lead counsel in the $33.8 million Dixon v. USA victory, the largest medical malpractice verdict in Florida that year and the largest medical malpractice verdict ever recovered in Miami-Dade County to date. The case involved a male infant who was the victim of malpractice, and as a result suffered severe injuries due to the delivering doctor failing to address a fetal heart rate emergency. At the time of the medical emergency, the negligent OBGYN was on the phone with his investment advisor finalizing a real estate transaction.
Sharp’s ability to effectively, and with precision, utilize the tools in his strategic legal toolbox to aid victims of medical malpractice negligence birth injuries and their families has not waned since that victory.
He recently recovered a $12,000,000 record-setting settlement in the Federal Tort Claim Action styled HACKING v. UNITED STATES OF AMERICA (Case No.: 2:19-cv-14449-), filed in U.S. District Court, Southern District of Florida in Ft. Pierce, Florida and defended by the United States Attorney’s Office in Miami, Florida. This Settlement Represents The Third Largest Medical Malpractice Settlement Nationwide In 2022 And One Of The Top 21 Personal Injury Settlements Across The Entire United States For 2022.
The $12 million birth injury settlement resolved Mallard & Sharp, P.A.’s infant client’s claims, as well as the claims of her parents. The Federal Government was a party to the case due to the fact that the acts of medical negligence that occurred during labor and the baby’s delivery were committed by a certified nurse midwife who was employed by Florida Community Health Center, Inc. in St. Lucie, FL (and was therefore a deemed employee of the Federal Government). The midwife failed to pay attention to the unborn baby’s fetal heart rate (FHR) when it became a Category III medical emergency that showed the baby was suffering from severe blood and oxygen deprivation and the need for an emergency C-Section performed by a physician was required. Additionally, the nurse midwife failed to notify the OBGYN that she needed help.
The baby suffered significant injuries as a result, including Hypoxic Ischemic Encephalopathy (HIE) and cerebral palsy. In excess of 70 depositions, including 38 from experts, were taken in preparation of trial before the settlement.
This recovery represents the largest birth injury settlement with the Federal Government in Florida against the Federal Government, and one of the largest settlements nationwide. The settlement is also one of the largest Federal Tort Claim settlements of any type, if not the largest, that has been recovered for a personal injury action in the State of Florida.
Richard Bo Sharp, Esq. and Mallard & Sharp, P.A.’s goal is to obtain justice for individuals and families who are the victims of birth injury medical malpractice, especially when it occurs during labor and delivery.
Sharp stresses the importance of having expert legal assistance in such cases. “If you think your baby was the victim of medical negligence, do not expect the negligent doctor or hospital to admit fault and take responsibility for their actions…they won’t. In nearly all cases in which a baby is the victim of medical malpractice, the child and family will never be compensated for their injuries unless they hire an attorney.”
